DOH Certificate of Need Listening Session Schedule for Home Health: Home Health | January 31, 2023 – 4:30pm – 6:00pm (may end early)
HCAW has been working with the WA State Department of Health (DOH) to update the Home Health Certificate of Need (CON) state regulations. The regulations around Home Health CON have not been updated since the 1987 State Plan. The regulations are not in the Washington Administrative Code (WAC). The industry has changed significantly over the years and the CON regulations are in need of a major update.
HCAW hired Berg Data (Marc Berg) to analyze the CON data for Washington state home health agencies. A new methodology has been developed and will be refined over the next year as the DOH rule-making for the Home Health CON begins.
The actual rule-making will be initiated after the 2023 legislative session when the DOH has the capacity to gear up again after the session. Agency rule-making can take 6 months to over a year if the rules get controversial. The Administrative Procedure Act (chapter 34.05 RCW) requires all state agencies to engage the public in rule development and outlines the process they must follow.
The Listening Session below is hosted by the DOH to get ideas of what may be needed for the CON program in the future. Marc Berg and Leslie Emerick will present an overview of the new Home Health CON methodology approved by the HCAW Board. We strongly suggest that you get involved in the stakeholder process. This session will be an excellent opportunity to learn about the new proposed methodology for Home Health CON and to get involved in the stakeholder process as it evolves in future rule-making.
